E152 ‘EU AI Act: Practical Insights and Compliance Strategies’ with MHC’s Brian McElligott

Today’s guest is Brian McElligott, Partner and Head of AI at Mason Hayes & Curran LLPIn this discussion, Mark and Brian talk about the EU AI Act and its implications for businesses and the market. 

The session aims to provide practical insights rather than a detailed legal analysis. The EU AI Act, which was finalised recently, will come into effect on August 1st and aims to regulate AI systems similarly to how product safety laws work in the EU, focusing on market surveillance and CE marks rather than fundamental rights.

Brian highlights the Act’s categorisation of AI systems into four risk categories: banned, high-risk, limited risk and low risk. The Act targets AI systems rather than general-purpose AI models, emphasizing pre-market and post-market regulatory regimes, especially for high-risk (regulated) AI. He notes that while detailed compliance guidelines are lacking, companies need to prepare for the upcoming standards expected within nine months.

The conversation also touches on the global regulatory landscape, with the U.S. also moving towards AI regulations. He emphasises the importance of companies having AI policies to manage the use of AI tools like ChatGPT, especially given the prevalent use of AI in day-to-day operations. Training for AI literacy is mandated by February 2nd next year, though the specifics of this training vary by organisation.

Brian points out the complexities and rapid developments in AI regulation, including ongoing legal cases and data privacy issues. He notes recent decisions like the Hamburg data protection commissioner’s statement on AI models not containing personal data without processing, which helps clarify compliance requirements.

Key dates for the EU AI Act include:

  • August 1, 2023: Act comes into force.
  • February 2, 2025: Prohibitions in Article 5 become applicable.
  • May 2, 2025: Codes of practice for model providers due.
  • August 2, 2025: AI systems provided before this date have until 2027 to comply.

Overall, this podcast underscores the need for businesses to stay informed and proactive in complying with AI regulations to avoid penalties and ensure responsible AI use.
